MBE Certification in New York
Complete guide to getting Minority Business Enterprise certified in New York, requirements, documents, costs, and step-by-step application process.
How MBE certification works in New York
New York State runs the largest state-level MWBE program in the country, and the fundamentals are unusually favorable: the application is free, certification lasts five years, and the state sets a 30% MWBE utilization goal that it reports exceeding, 32.21% in fiscal year 2023-24. Empire State Development's Division of Minority and Women's Business Development administers it, with applications filed online through the New York State Contract System.
Eligibility has real ceilings. The firm must be at least 51% owned, operated, and controlled by eligible owners, with at least one year in business, no more than 300 employees, and a personal net worth cap of $15 million adjusted for inflation. The application's One Stop Addendum is worth using: it can forward your state application to New York City's SBS program, Erie County and Buffalo, and the Port Authority, which spares you re-documenting everything for each.
Two things to track in 2026. ESD published proposed MWBE regulatory amendments with comment open through June 29, 2026, so details may shift later this year. And the corporate credential remains separate: the New York and New Jersey Minority Supplier Development Council certifies MBEs for corporate supplier diversity programs through the NMSDC Hub, on the national fee schedule of $270 to $1,700 by revenue.

For businesses that are at least 51% owned, operated, and controlled by one or more minority group members.

What the 30% goal does for certified firms
New York's 30% MWBE utilization goal applies to state agency and authority contracting, and the state publishes its results, most recently 32.21% utilization in FY2023-24. Agencies hit those numbers by setting MWBE participation goals on individual contracts, which keeps prime contractors searching the certified directory for subcontractors.
State certification does not cover New York City contracts; the city runs its own program through SBS. The efficient path is state first, then the One Stop Addendum or the city's FastTrack lane, both of which accept the work you already did for ESD.

How to Apply for MBE in New York
- **Step 1: Identify your regional affiliate council**
- NMSDC does not process applications directly. All certification is handled by one of 23 regional affiliate councils. Go to nmsdc.org, find the council covering your state, and read its specific instructions before starting. Timeline expectations, portal systems, and site-visit processes vary by council. Some councils use the national NMSDC portal; others use their own.
- **Step 2: Gather documents before opening the application**
- Most council portals time out or lose progress. Assemble everything before you start: three years of personal and business tax returns, a current P&L and balance sheet, articles of incorporation or organization, your operating agreement or bylaws, stock certificates or membership ledger showing the minority owner's percentage, a current business license, and a photo ID for each minority owner. If your business has clients, have a few representative contracts or purchase orders ready — some councils request them.
- **Step 3: Submit the online application and pay the fee**
- Fees are set by each regional council and scale with company revenue: $350-$650 for most small businesses, up to $1,250 for larger companies. Pay promptly — some councils don't begin review until the fee clears. The application itself takes 2-4 hours for a first-time applicant. Inconsistencies between your answers and your documents are the most common reason for follow-up requests that delay processing.
- **Step 4: Prepare for the site visit**
- After application review, the council schedules an on-site verification. This typically occurs 30-60 days after submission. The reviewer will visit your actual place of business, speak with the minority owner, and may talk with employees. The purpose is to verify that operations match the application and that the minority owner is genuinely in charge. Have the minority owner lead the visit. If the business is home-based, the reviewer visits the home office.
- **Step 5: Certification committee review and decision**
- After the site visit, the council's certification committee reviews the full file. Most councils issue a decision within 60-90 days of a complete application. If additional information is requested, respond within the stated deadline — late responses push your file to the back of the queue.
- **Step 6: Activate your profile in the national database**
- Once certified, update your profile in NMSDC's national supplier database immediately. Corporate buyers search this database when building diverse supplier pipelines. An incomplete profile means missed matchmaking opportunities. Include NAICS codes, capability keywords, and relevant certifications you hold.

MBE in New York: common questions
How much does New York State MWBE certification cost?
Nothing. ESD states the application process is free. Certification lasts five years, with the recertification window opening 90 days before expiry. The corporate NMSDC credential through NYNJMSDC is separate and follows the national fee schedule of $270 to $1,700 by revenue.
Who qualifies for New York MWBE certification?
Firms at least 51% owned, operated, and controlled by eligible owners, in business at least one year, with no more than 300 employees and owner personal net worth under the $15 million inflation-adjusted cap. All of it is documented through the New York State Contract System application.
Does state certification cover New York City contracts?
No. NYC runs its own M/WBE certification through Small Business Services. The state application's One Stop Addendum can forward your file to the city, and the city offers FastTrack review for firms already certified by ESD, so the second certification mostly reuses the first one's paperwork.
Is the New York MWBE program changing in 2026?
Possibly at the margins. ESD published proposed MWBE regulatory amendments with public comment open until June 29, 2026. The program itself, the free application, the five-year term, and the 30% goal were all in force as of July 2026; check ESD's MWBE page before relying on details later in the year.
